Verify by Visa & MasterCard SecureCode

Here at Watchfinder we insist on the highest levels of security on all payment card orders. To support our fraud screening program we have implemented Verified by Visa (VbV) and MasterCard SecureCode (SecureCode).

What are they?

Verified by Visa and MasterCard SecureCode are security programmes from Visa and MasterCard which give you enhanced protection when shopping online. They allow you to create your own personal password, known only to you, for use as an extra security measure each time you use your Visa and MasterCard payment cards to make a future purchase online. Watchfinder have been processing online payments for 8 years and we put all of that experience into our payment security so that you get the peace of mind you need when shopping online.

How do they work?

You only need to register with VbV and SecureCode once to create your password for each of your payment cards. Then whenever you shop online using your registered cards you will be asked to enter the relevant password as an additional validation before the order is confirmed.

What do I need to do to register?

To register with VbV or SecureCode you need to complete the details in the box on the right so that Visa or MasterCard can verify your card. After entering your personal details you will then be asked to create a personal password which will be used to authenticate future orders placed online with your Visa or MasterCard payment cards at participating stores. The details you enter in this process will be submitted to your card issuer over a secure link; this information will not be held/viewed on any of Watchfinder.co.uk internal systems.

What if I am already registered?

If you have already registered you just need to enter your personal VbV or SecureCode password as indicated in the box on the right to continue.

Any other questions?

If you have any questions regarding this process please contact your card issuer.

Sell Your Watch

+-

Definitions

The terms below will apply to every purchase of a watch by Watchfinder.co.uk Limited ('Watchfinder' or 'we'). Please note that all communications, whether by email, internet, telephone, fax, post, face to face or other means are conducted on a "subject to contract" basis. No legally binding contract between you, the owner of the watch which is the subject matter of the purchase (the 'Seller' or 'you') and Watchfinder will be formed in any circumstances until: (i) Watchfinder has had the opportunity to conduct an on-site valuation of the watch and inspect any accompanying documentation, AND (ii) a physical examination of the watch has been conducted by a qualified watchmaker or technician on behalf of Watchfinder (which may in some cases take place at a later date); AND (iii) the parties have entered into Watchfinder's standard written contract of purchase which incorporates the terms stated below.

The Seller's attention is drawn in particular to the provisions of clause 14.

+-

1. Pre-contract information

a. In most cases, you will receive two valuations: one valuation for a trade sale and one to be sold on a commission basis. You will need to provide us with certain information about the type and condition of the watch that you want to sell.
b. Both valuations are provided on a "subject to contract" basis and are not legally binding. We reserve the right to withdraw the valuation at any time without legal consequence and with no liability to the prospective Seller.
c. You warrant that you are the legal owner of the watch and, in the event of an agreement for sale, consents to transfer the full unencumbered legal title and full ownership of the watch to Watchfinder.
d. In the event that the watch is listed on the website (www.watchfinder.co.uk), we reserve the right to remove the watch from the website for any reason and at any time. We will promptly notify you in the event that such action is deemed necessary.

+-

2. Price quoted

a. The price quoted in the valuation will be in Pounds Sterling and be defined as the net cost; please see the VAT margin scheme for further details. Companies should enquire as to their VAT implications.
b. All prices quoted in the valuation are given in good faith and are derived from a combination of factors including the information supplied by you. The provision of inaccurate, false or misleading data by you will result in an inaccurate valuation which cannot be relied upon by you.
c. If for some reason an error in the valuation quoted has occurred, we will rectify the price as soon as reasonable practicable after notification of the mistake. No liability whatsoever can be accepted by Watchfinder for accidental mistakes or errors caused by system failures.

+-

3. Risk and title

a. The watch will be our responsibility from the time of delivery to our offices.
b. Ownership of the watch will only pass to us at the earliest of either: (1) when you receive full payment of all sums due in respect of the watch; or (2) we successfully sell your watch on your behalf, unless the watch is returned to us by the customer pursuant to the Consumer Protection (Distance Selling) Regulations 2002, in which case title remains with the seller.

+-

4. Payment

a. All payments made by Watchfinder shall be in Pounds Sterling and paid to such account as you may notify Watchfinder. We will not make payment by cheque. Payment to a nominated third party will generally be unacceptable. International sellers may be subject to an additional bank charge.
b. Payment will usually be made by BACS transfer and cleared funds may take approximately 3 working days to arrive after payment has become due, depending on the transfer method. No liability is accepted by Watchfinder for any delay which was unavoidable in the circumstances.
c. We reserve the right to pay by any other appropriate payment method when and where reasonable.
d. Payment will not fall due if we rescind the contract within a reasonable period after the physical examination by a qualified watchmaker or technician.
e. For watches sold on a commission basis, a charge of 20% of the total sale price applies, subject to a minimum charge of £250.00.
f. Any outstanding monies owed to Watchfinder, including servicing costs, will be deducted from any payment or commission.
g. For watches sold on a commission basis, please note that the customer has a 7 working day 'cooling off' period in which time they can return the watch for a full refund, due to the Consumer Protection (Distance Selling) Regulations 2000 (DSRs). If the customer gives Watchfinder a notice of cancellation within 7 working days following the day after delivery of the watch to the customer, then no payment will be due from Watchfinder to you. Watchfinder accepts no liability for a delay in the return of the watch from the customer. Once the watch is returned to Watchfinder, the watch will be relisted on the site. Provided that the contract is not cancelled by the customer under the DSRs, you will usually be paid within 14 working days following the expiry of the 'cooling off' period. Please note that this clause applies regardless of whether or not the customer purchased or collected the watch from one of our showrooms.

+-

5. Seller's warranties

The Seller warrants that:
a. all the information supplied during the valuation process is accurate and true;
b. the watch is not subject to undisclosed finance;
c. to the best of the Seller's knowledge and belief, the watch has not been an insurance write-off or has been subject to substantial remedial repairs;
d. the serial numbers and documentation are genuine and accurate and that the watch has not, to the best of the Seller's knowledge and belief, been tampered with;
e. there are no undisclosed physical defects with the watch that a prudent purchaser would want to be informed of;
f. there are no undisclosed "title defects" with the watch that a prudent purchaser would want to be informed of;
g. the Seller is the legal owner of the watch, has the right to transfer the full unencumbered legal title and full ownership of the watch to the Company; and
h. no other person has any claim to the watch whether legal, equitable, possessory or otherwise.
Once a sale has been agreed (between the buyer, Watchfinder, and the Seller), the Seller can only cancel with the express written permission of Watchfinder. The Seller will be liable for any consequential loss of profit to Watchfinder or any charges incurred, which will be detailed to the Seller before the cancellation request is approved.

+-

6. Buying in slip

a .All sellers further agree to the following conditions:
(i) You hereby confirm that the watch is your property and that you are entitled to sell free from any charge, lien, burden or adverse claim, including all hire.
(ii) You accept that every element in the description of the watch, including its make, model and serial number, is a material and essential part of its identity and that the absence or non-fulfilment of any such element renders the watch in the perception of Watchfinder and you radically and fundamentally different from the watch that the you have agreed to supply.
(iii) You undertake that you have not concealed any fact or matter concerning the identity, quality, history, provenance, authenticity, legal status or general character of the watch, which might reasonably be regarded by a reasonable and prudent buyer in Watchfinder's position as material to, or otherwise liable to influence, the decision to buy the watch.
(iv) You understand that you are fully responsible for any breach of the preceding conditions and remains so until discovery of such breach by Watchfinder. You are also responsible for any defects in design, material or workmanship, latent or otherwise.

+-

7. Delivery

a. The watch must be delivered by you to designated premises allocated by Watchfinder at your risk and expense. The watch is your responsibility until it reaches the offices of Watchfinder. You should ensure that you package the watch appropriately to prevent any damage to the item while in transit. We recommend that you obtain proof of posting.

c. Obtaining adequate insurance for the item while in transit is your responsibility.

+-

A revised valuation may be offered where: (i) the watch does not fully comply with the information provided during the valuation process; (ii) the condition is such that it has a substantial impact on the value of the watch; (iii) other relevant factors not disclosed affect the valuation; and/ or (iv) for any other reason.
b. In addition to the initial valuation, the watch may be physically inspected by a watchmaker either before or after you have agreed the valuation or sale contract. If the physical inspection by the watchmaker is carried out after the written contract has been completed and agreed by you, we may rescind the contract for any serious defect subsequently discovered in the watch by such inspection.
c. This inspection can be carried out at any time the watch is the property of Watchfinder.

+-

9. Servicing

a. All watches entering Watchfinder undergo a full test at point of entry into our stock management system to ensure the functionality and presentation of the watch meets our high standards. The cost of any work deemed necessary is estimated and sent to the customer for approval. Any necessary work must be completed before the watch can be listed on our site.
b. Watches are precision instruments with moving parts, therefore wear and tear is the unavoidable result of any mechanical movement. In time, all mechanical watches will need intervention via an overhaul/service to ensure they continue to work to the highest level. This period of time depends on, amongst other things, the brand and model, but it is recommended that all watches are serviced every 3-4 years to maintain their level of accuracy. As watches can be held in the possession of Watchfinder for some time before being sold and dispatched, particularly where sold on a commission basis, please note that watches may on occasion need servicing between the period of arrival with Watchfinder and sale. Any such work deemed necessary by Watchfinder will be at the Seller's cost.

+-

10. Servicing and refurbishment costs

Where you have authorised (whether orally or in writing, which shall include e-mail correspondence) any servicing, refurbishment or other work to be carried out on the watch, you will be charged for this work in accordance with the price agreed between the parties, regardless of whether or not the watch is subsequently sold. Please note that estimates by Watchfinder are given in good faith, but are estimates only. Where the watch is not sold, Watchfinder will return the watch to you on receipt of cleared funds only (please see "Lien" below). Please further note that if Watchfinder arrange for a third party to prepare a quote for servicing or other work to be carried out on your watch, but you do not proceed with the work in question, an administrative charge may apply.

+-

11. Lien

Watchfinder shall have a lien on all goods in their possession which are the property of you to secure payment by you of all sums due from you to Watchfinder.

+-

12. Part exchanges

a. A part exchange allowance will be agreed between Watchfinder and the Seller in tangible form. Where an order is cancelled (by either party) in which a part exchange is involved, Watchfinder may at its sole discretion offer either a return of the watch or payment of the part exchange allowance.

+-

13. Insurance

a. Any watch in the possession of Watchfinder is covered under its insurance policy, the replacement value which will be defined as latest and most accurate trade sale valuation, less any outstanding costs owed to Watchfinder in the form of advertising, postage, servicing fees or any other charge.

a. If we fail, at any time during the term of a contract, to insist upon strict performance of any of your obligations under the contract or any of these terms and, or if we fail to exercise any of the rights or remedies to which we are entitled under the contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.
b. A waiver by us of any default will not constitute a waiver of any subsequent default.
c. No waiver by us of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

+-

17. Severability

If any court or competent authority decides that any of the provisions of these terms and conditions or any provisions of a contract are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.
